但一点建议可供参考。近日和这里某位仁兄关于儿童裸体艺术摄影的话题进行了切磋，虽然结果是公说公有理，婆说婆有理，可是发现澳洲法律和大众观念对于这方面“清教徒”的倾向非常严重，稍有不慎就是严重的刑事犯罪，如个人下载、保存、收藏和传播涉嫌儿童色情的作品（即使看似儿童、即使没有明显的性暗示等等都有可能犯罪，或者被认为是违法）、儿童裸体摄影等。有些澳洲知名人士甚至遭遇牢狱之灾。

相对于亚洲国家，如日本甚至是某国，澳洲法律在这些方面非常苛刻，希望各位小心为上。不要以为看看没啥，不要把日本和在某国争取权利的经验用到澳洲。不要到时没被某国的网管河蟹了，反而被民主自由的澳洲法律给河蟹掉了。

建议各位在澳的网友勿上传和下载涉嫌儿童色情的作品，以免被举报违法。

不违法，也不要做涉嫌违法的事情。

这里大家争论的一个焦点就是”explicit sexual activity“。什么是”explicit“，我想xx的辞典里是”Fully and clearly expressed; leaving nothing implied.明白的，清楚的：表达得完全的和清楚的；毫不含糊的“。因为是要清楚的表明有色情成分，如性交等真实明确的行为才是色情。只有清楚明白的色情才是色情，性暗示、模拟性交等等由于模糊不清所以按照ＸＸ的逻辑都是不应该归入此类的。是不是？

简单的解释就是能引起性幻想的作品不应该受此限制。

Sexually explicit material (video, photography, creative writing) presents sexual content without deliberately obscuring or censoring it. The term sexually explicit media is often used as euphemism for pornography. It includes unsimulated sex acts, sexual intercourse and uncovered genitalia（性器官）.

裸露主要性器官就不论了，女人裸露乳房和男女性器官附近的毛发也是被公认是”sexually explicit“，那儿童裸体摄影中的裸露性器官及附近的毛发和裸露女童乳房（如文中的实例）是否就不是explicit。如果归入了explicit的范畴，那根据法律是不是属于Child pornography？这个法律条文源于《Child pornography in the digital age》，所以我不能胡乱下判断就说所有的儿童裸体艺术（如绘画，如不裸露性器官的作品）都属违法。
