走法律程序，对方有第3方保险，如果赢了，对方的保险公司会理赔吗

如题，第一次出事故，被人追尾，对方全责，而且有第3方保险，但就是不肯去他的保险公司claim，
我不是全险，只好自己追。
如果我上法庭赢了的话，对方的保险公司会不会理赔？是否还需要他的同意？

Go for court first, then the offended side choose the way to pay you - by him individuality or go for insurance.
If go for insurance, the insurance company will review it, but for your case, they may not bother you.

So it is none of your business to know how he will pay you for this case.It's all up to him.
