Hanson移民留学之二-澳大利亚移民协会关注TRA政策变化 201014日,新年的第一个工作日,很多在读TAFE和即将抵达澳大利亚就读TAFE的申请人,通过电话,EMAIL,及面谈向我询问有关TRA申请的要求,我也就这些问题之前写过一篇报道。如下应该是大家关心的一些问题,澳大利亚移民协会MIA也就这些问题,已经向TRA发出了澄清,请大家分享并讨论。以下英文版本版权属于MIA,中文翻译草草完成,如果有误,请指正。祝大家好运! Hanson. Sun

以下是英文全文,加上简单的中文翻译。Concerns1) TRA office closed on 24December 2009 without notifying that couriered skills assessments will not beaccepted during the holiday period until after the new changes are introducedon 1 January 2010. We understand that TRA will return applications arriving atTRA after 24 December 2009 but before 1 Jan 2010. With no notice given of theextent of the changes, we request that such applications be accepted.
TRA20091224日因圣诞节假期休息,知道201011日新政策公布才通知假期中收到的申请将不被承认,可能会被认为是无效申请。
2)  Insufficient definition ofhow many hours total a week of fulltime work.
没有足够的定义JOBREADY TEST中每周全职工作究竟是多少小时?

3)  None of the forms that willbe used by employers are ready yet.
直到目前为止,201018日,雇主需要在TRA注册表格还迟迟没有公布。
4)  Agents cannot advise how aworking holiday maker on a 417 visa now meets the skills assessment for a 487visa, as the job ready test does not work for their visa duration.
移民中介不能给予417签证持有人解释如何满足职业评估要求继续申请487签证,并且JOB READY TEST417签证有效期内应该是不能完成的。
5)  Agents do not know how toadvise 485 visa holders with less than 12 months left on their visas - how canthey meet this job ready test?
移民中介不能给予485签证仅有12个月的申请人如何去完成JOB READY TEST的建议,因为时间方面已经不够了。
6)  Agents do not know how highlyskilled and relevant trades work that has taken place before 1 January 2010will be counted for onshore GSM applicants given it was not filled out on oneof the TRA recording sheets or they did not register within one month ofstarting.
移民中介对于TRADE工作级别高低是如何定义的,201011日之前,申请人的雇主没有在开始工作的一个月内在TRA注册的工作经验是否能够被认可?
7) Disadvantages students alreadyon 485 Visas - they are now unable to gain sufficient work experience tocomplete the job ready program.
已经持有485签证的申请人因为时间等原因可能没有机会完成JOB READY PROGRAM.
8) The 12 months work experiencerequirement is likely to be very difficult to achieve because:
12个月的全职工作经验很难完成
a. Part time work does not appearto be something which can be counted. If this is the case, students will not beable to count work experience obtained whilst studying.
每周20小时的兼职工作不能算入12个月工作经验中,申请人不能在学习过程中积累。

b. 485 visas are valid for only 18 months. This gives a very tighttimeframe to obtain a suitable job offer as the skills assessment process mustbe finalised prior to the expiry of the 485 visa for lodgement of a permanentor provisional skilled visa.

485签证仅有18个月有效期。申请人仅有的有限时间去寻找合适的工作经验,并且在485签证过期前完成JOB READTY TEST,然后在再递交申请。
9) Our understanding is that manyemployers may be unwilling to submit to the required level of oversight by TRAStage 4 - Job Ready Final Assessment. The changes are particularly toughfor 487 (Regional Sponsored) applicants:
很多雇主不情愿协助完成TRA第四步-JOB READY FINAL ASSESSMENT
这个该别特别对487签证将更加严格。

a. Sponsorship is required prior to visa application and can take severalmonths. This means an even tighter timeframe.

担保需要在递交申请前完成,这需要几个月的时间,意味着整个时间上的安排将更加吃紧。

b.  Working holiday makers who would otherwise be able to apply for a 487do not have sufficient time to undertake the job ready program as their visasare valid for 12 months only.

Working Holiday前后曾持有人不能申请487签证,是因为其签证只有12个月有效,无法完成JOBREADY TEST.
10) We have very little detail onwhat the workplace assessment will involve. Until such details are released,there is a possibility that students will undertake the process with no ideawhether they are likely to meet the required level of skill to pass the assessment.
TRA没有提供更多WORKPLACEASSESSMENT审理细节,直到现在也没有公布,申请人没有注意是否他们目前的工作达到了规定的级别。
11) We are concerned aboutpossible waiting times for the various stages of the process meaning thatclients have even less time to meet the requirements.
TRA审理的4个步骤都需要相应的时间当代,申请人的时间将会更加吃紧。
12) The criteria for offshoreapplicants are still significantly tougher than onshore applicants (ie Cert IIIplus 4 years of full-time work experience versus Cert III plus approx 18 monthsof work experience).
境外申请人的难度将更加大于境内申请人,例如境外是同于三级证书加上4年全职工作,境内是三级证书加上18个月工作经验
TheMIA is seeking to obtain clarity on:MIA希望TRA澄清:1. If an applicant already has a TRAassessment under the pre 1 Jan 2010 criteria, are they exempt from any of thenew process (eg Stage 1)?
201011日前通过TRA的申请人,是否能够等同于完成新政策STAGE 1
2. For the first stage of the process,how much work experience is required? Website information suggests six months,but other indications are that the criteria are similar to the pre 1 Jan 2010criteria (900 hours)? What level of skill must be exercised at each stage? Atwhich point must the applicant be employed as a fully qualified tradesperson?
新政策下,第一步申请中,究竟需要多少工作经验才能通过?网站说明是6个月的工作经验,但并没有具体说明是多少小时?是否还是之前的900小时?每个步骤中工作的级别是什么?具体在哪一个时间点,需要雇员是完全符合资格的tradesperson?
3. When will the employer documentation(template contract of employment and registration) be available?
什么时候雇主与TRA的注册表,与雇员的合同能够在网上提供?
4. What arrangements will be made forappeals for each stage of the process?
每步中,如果出现申请失败,如何完成复议。
5. How much of the process will berequired for other permanent visa applicants (eg ENS)?
雇主提名签证申请,需要多少费用完成TRA审理?
6. Does TRA plan to make anytransitional arrangements for applicants already on 485 visas?
TRA是否会给予更多过渡政策给已经持有485签证的申请人?
