我们有没有资格申请政府首次购房补贴

我本人从未购房，假如是单身购房当然就不用咨询这个问题了。

问题还在于我的partner，若申请首次购房补贴必须看你们两个人的条件，假如有一方过去购房时曾享受过首次购房补贴，那你们就没有资格享受。若政府今后调查出你的Partner曾经购房享受过住房补贴，不仅会被追回补贴，还要被罚款。

他10年前曾买过房子，尽管现在没有属于他的房子，他过去买房时因为当时的收入较高就没有能享受到政府首次住房补贴。也就是说，他从未享受过政府的首次购房补贴。

那我们若考虑购房，能不能有资格拿到政府首次购房补贴呢？

买房是两个人合在一起贷款更容易、更保险些，也不能只考虑这1.4万政府补贴。

更主要在澳洲，你们生活在一起就要被视为defacto配偶，分居了就不称配偶了，而不取决于一张证书。

Eligibility To Receive The Grant

To be eligible to receive the grant, the SRO must be satisfied that:

    * You and your spouse/partner have not received a grant in any State or Territory of Australia.
    * You and your spouse/partner must not have owned residential property, either jointly, separately or with some other person prior to 1 July 2000, in any State or Territory of Australia.
    * You and your spouse/partner must not have occupied for a continuous period of at least 6 months, a residential property in which either of you acquired a relevant interest on or after 1 July 2000 in any State or Territory of Australia.
    * You must be a natural person (not a company) and at least 18 years of age at the time of settlement or completion of construction.

Note: the Commissioner of State Revenue (the Commissioner) has a discretion under the First Home Owner Grant Act 2000 to exempt an applicant from the age requirement where the home will be occupied as the applicant's principal place of residence.

    * You (or at least one applicant) must be a permanent resident or Australian citizen at the time of settlement or completion of construction of the home.

Note: A permanent resident includes the holder of a permanent visa under section 30(1) of the Migration Act 1958. New Zealand citizens holding a special category visa under section 32 of the Migration Act 1958 also satisfy this requirement.

    * You (or at least one applicant) must occupy the home as your/their principal place of residence for a continuous period of at least 6 months, commencing within 12 months of either settlement or completion of construction (the residency requirement).

The Commissioner may approve a lesser period if he is satisfied that there are good reasons why you cannot comply with the residency requirement. The Commissioner also has discretion to extend the 12 month period if satisfied that you cannot begin occupying the home within 12 months of settlement or completion of construction due to circumstances that were unforeseen or beyond your control. You should contact the SRO and provide written reasons as soon as you are aware that you may not be able to satisfy the residency requirement.

买过房子，不管是否拿到补贴，也不算是首置房了。

对两人关系的定义在澳洲与中国不同，在中国看证书、在澳洲看事实关系。

当然，有人也可以在申请社会福利（比如失业金）或首次购房时，隐瞒两人的真正关系。

多数情况是不能拿到首次住房补贴，因为他曾在2000年前买过房子，只是并没有偿还银行贷款。

反正，以后购房时还可以就此特殊情况咨询律师。

我的个人观点：

在澳洲，单身一人可以考虑租房，低收入可以申请租房补助、符合条件的还可以申请政府公房。为什么一定要买房？单身人士买房后将给自己带来不小的压力，即使你在买房后结婚，这套子将来还是属于你们家庭。

假如是两个人租房生活，毕竟不是长久之计。

    However, a person may be eligible if they or their spouse (including de facto spouse) has only ever had a relevant interest in any residential property in Australia on or after 1 July 2000 and they have not resided in that property for a continuous period of at least six months.

这就是一怪圈，一个人的经济状况不够独立买房，所以要合力买，可是又失去了本来就雪中送炭的补贴。

你太误解我的意思了。

你看在澳洲的政策中：‘you or your spouse (including de facto spouse) ……’，

假如让你否认你有老婆，你是办不到的。同样，让你否认你有partner也办不到。除非某人是别有用心了。

并不是一个人的经济状况不够，才找人合起来买房。这么做，买房的意义何在？而是两个人彼此成为共同生活夫妻或伴侣，互相信任，才会考虑共同买房。

我们多数情况不能得到首次购房补贴，政府的分配政策基本也是公平的，我们也没什么遗憾。

我是更不明白了，为啥单身时候不能买房？或者不考虑买？非要两个人才能买？买了再结婚就不合法了？就不行了？这和补贴关系不大，不是为了补贴买，而是买了房子才有安定的感觉，“有恒产者有恒心”嘛

其实我只是咨询我们这种情况有没有房补的问题，有就有、没有就没有。

只是你在2楼想到其它问题上。所以我在前面不厌其烦的解释：澳洲某些政策上对领过证书的已婚夫妇与同居事实婚姻都是一视同仁的。

以前也曾有一位网友发表过另一个贴子咨询：他和他的同居女友每人买一套房子，买房后再结婚，是不是可行？

还曾看过一则新闻，有人在享受首次购房补贴后，后来被调查到他的partner 过去曾有过购房记录，政府追回了首次购房补贴并罚款。

政府对发放过首次购房补贴的，一般在一年内会调查购房者。在第一年内把房子出租的，调查后也要被追回这笔补贴。

我想你第二段所说的是单人曾经买房，婚后再一起买房，这时候的住房补贴的确不应该申请。
但是如果两者都是婚前买房，婚后应该是不用退钱的。难道政府要下令凡是申请了住房补贴的不许结婚么？这就是大笑话了。

rondy的意思是，如果已经有事实婚姻关系（包括同居啊），那么不应该欺瞒政府骗多一次补贴。如果只是各自买好房子之后结婚，没问题的
不至于要为了这1w多就否认双方关系吧？那不如分别办一个假结婚赚的多呢

这里的关键是 什么叫defecto？

我想谈个男女朋友应该不算吧。

比如说 gay couple 领养了孩子，比如说已经生育了孩子的，还没结婚， 比如说，一个人养活另一个人的，这些都会反映在税务上的。 这些叫defecto吧。
政府只关心税金之类的问题，对两性关系貌似无所谓的。

那当然是因为Rondy他们已经算是defecto啦，所以不会为了这个购房补贴故意解除关系吧？
更关键的是，一起买房子，一起贷款供房，算是两个人对家庭生活的一个计划。跟是否登记结婚没关系
如果要领补贴，必须完全独立购买，房子只写一个人的名字，就没有特殊意义啦

有女朋友或有男朋友，也不见得就是defacto partner。

假如我有勇气一个人先买房，当然也可以找华人贷款律师帮助解决，假如收入不够还可以找亲属担保贷款。但是，觉得这样做太累了。买房之后，两个人就不生活在一起了吗？如何提供两个人以前不是partner的证明呢？

两个人首付积蓄只有这些，总希望投到一套房子里内，也不能只为了政府的这些补贴去多买房。

对我来说，假如找到了自己的伴侣，将来一切就都靠我们两个人，也不能只考虑自己买几套房子的问题，还要想想国内的父母。尤其是我爸爸患病，国内的物价越来越高，还有一套小房子出租以后可以不担心医疗和请人护理费用问题。

我对你的问题这么看:

1. 如果你们同居在一起超过12个月,而且还有其他人做WINTNESS,你们就因该被定性为DEFACTO SPOUSE RELATIONSHIP, 然后你的PARTNER已经拥有过房子 PRIOR TO 1ST OF JULY 2000. 所有你不可以再享受FIRST HOME OWNER GRANT.

2.如果你们能够证明你们不是DEFACTO RELATIONSHIP,即便你们在一起住,你也没有买过房子你就可以享受FIRST HOME OWNER GRANT.

总结, 我认为你可以享受FHOG,只要你能坚持并证明你们只是男女朋友关系而非DEFACTO. 最后可以打电话给每个州的OSR.

你的分析我非常赞同。

有很多事情，包括centrelink的某些福利、纳税申报等，都存在有配偶和无配偶的问题。在澳洲不看你有证无证，如果否认两个人的事实关系，就等于违法法律。

对每个人来说，是觉得两个人分开享受政府福利更好；还是以配偶关系共同生活得益更多？这取决于每个人的选择。

两个人婚前各买一套房子，尽管也合情合理，并不是一般人所能承受的。今天有工作，不等于明天不会失业。
