Poll shows support of gay marriage at high

BY: MILANDA ROUT AND MATTHEW DENHOLM From: The Australian August 07, 2012 12:00AM

SUPPORT for same-sex marriage has risen to its highest level, with a new poll revealing nearly two-thirds of the community want change as pressure continues to build on Julia Gillard in the wake of Tasmania's move to introduce its own laws.

The Galaxy research -- commissioned by Australian Marriage Equality -- also shows 52 per cent of Coalition voters want same-sex marriage reform and 44 per cent of voters would more likely support Tony Abbott if he allowed Coalition MPs a conscience vote on the issue.

It comes as Labor MP Stephen Jones, architect of one of the three same-sex marriage bills before federal parliament, urged the Prime Minister not to mount a High Court challenge against Tasmania if Lara Giddings was successful in getting legislation through the state's upper house.

The opposition and a number of Labor MPs have called for Ms Gillard to take legal action, with Tasmanian Liberal senator Eric Abetz saying the laws were "socially destructive" and Labor MP John Murphy saying it would set a dangerous precedent for states to interfere with federal laws.

Mr Jones told The Australian yesterday a High Court challenge would be a waste of taxpayers' money, and he welcomed the move by Tasmania to recognise that it was time for change. He said that as more states and countries embraced same-sex marriage, "the more pressure is placed on the objectors to say what exactly is your objection".

Ms Giddings received support from two of her counterparts yesterday. The ACT government indicated it would keep a close eye on the passage of Tasmania's legislation, with the possibility of going down the same path, and South Australian Premier Jay Weatherill sent her a message praising her state's move.

Australian Marriage Equality convenor Alex Greenwich said the Galaxy polling -- which sampled 865 people across the country -- showed support for same-sex marriage at 64 per cent, the highest level since polling on the topic began in 2009.

"The message to the federal parliament is clear -- if you ignore the aspirations of the majority of Australians and fail to support this reform it will occur anyway, state by state and territory by territory," he said.

It also emerged that Tasmania's upper house -- dominated by conservative independents -- might not be the barrier to Australia's first gay marriage law that many expected.

Public statements so far suggest the 15 legislative councillors are evenly divided between those for, against and undeclared. However, The Australian understands a vote held today would be indecisive and as likely as not result in passage of the bill.

Tasmania is the logical 'first mover' on marriage equality

August 6, 2012 - 9:35AM

Tasmanian Premier Lara Giddings has announced that Tasmania will pass new laws allowing same-sex couples to marry.

For some people it will seem strange that Tasmania could be the first place in Australia to allow same-sex marriages. Tassie has a reputation for homophobia that comes from being the last Australian state to decriminalise same-sex relationships. Besides, isn't marriage a federal issue?

Even if Tasmania's marriage equality law is struck down by the High Court, Tasmania and marriage equality still win.

Since homosexuality was decriminalised in 1997, Tasmania's progress on the recognition of same-sex relationships has outstripped the other states.

We were the first state or territory to enact a scheme for formally recognising same-sex relationships, the second to allow same-sex couples official ceremonies and the first to recognise overseas same-sex marriages.

Tasmanian Labor was the first to formally endorse the principle of marriage equality and the Tasmanian Parliament, the first to do the same.

Some might say we have made this rapid evolution towards equality despite our history, but I think it is because if it.

The divisive and drawn-out decriminalisation debate (not to mention the post-convict "sodomy-shame" that haunted us for a over century), has heightened our awareness of the damage caused by prejudice and discrimination.

Whatever the reason for Tasmania's rapid progress, that progress makes marriage equality the next logical step for the Apple Isle, and our island the most logical place for marriage equality to begin in Australia.

But does a state like Tasmania have the power to take such an initiative?

It is a common misapprehension that because the Marriage Act is a federal law, only the federal government can make laws for marriage.

In fact, as constitutional experts like Professor George Williams have pointed out, the federal constitutional marriage power is shared by the Commonwealth and state governments.

If there is a type of marriage not covered by federal law, the power to make laws for that type of marriage falls to the states.

This is why heterosexual marriages were performed under state laws until the federal Marriage Act was enacted in 1961.

It is also why, in the absence of federal laws about same-sex marriage, the states can now enact such laws.

Ironically, the person who can take most credit for this is John Howard.

When he amended the federal Marriage Act in 2004 to make it crystal clear that federal law only concerns itself with heterosexual unions, he also inadvertently clarified that the states have free rein to marry same-sex couples.

It shouldn't be a surprise that the states can and should lead on this issue.

The recognition of same-sex de facto relationships and same-sex parenting occurred state-by-state before it migrated to the federal level in 2008.

In every other federal nation where marriage equality has moved forward, including Canada, the US, Argentina, Mexico and Brazil, it happened first at a state or provincial level. Even in a unitary nation like the UK it is Scotland that is taking the lead.

Seen this way, it would be remarkable and anomalous if marriage equality didn't begin at a state level in Australia.

Of course, there are constitutional experts who disagree, arguing that the Howard government intended to stop the states as well as the Commonwealth recognising same-sex marriages (even though Howard never said this, and other proponents of the 2004 amendment admit it was an omission).

But this shouldn't stop Tasmania acting.

The federal and state governments often enact laws that raise constitutional questions - Howard's WorkChoices is an excellent example.

Indeed, Tasmania should relish the chance to defend its same-sex marriage law in the High Court (should anyone be willing and able to challenge those laws, which is by no means certain).

For most of my adult life, Tasmania has been on the wrong side of history in the High Court, defending dams that were never built and anti-gay laws that were later repealed.

Should Tassie become the High Court champion of what has been dubbed "the civil rights battle of our time", it will reinforce the message about how much the island has transformed. Even if Tasmania's marriage equality law is struck down by the High Court, Tasmania and marriage equality still win.

In the time it takes for the court to hear the case, thousands of same-sex couples from all over Australia will be married in Tasmania. They will have spent an estimated $100 million on their weddings, giving the state economy a much-needed boost.

They will have returned home and begun demanding the recognition of their solemn legal vows by their own state government.

Perhaps most important of all, people will not start marrying their pets, heterosexuals will not all suddenly divorce, churches will not be "thrown to the lawyers", and the sky will stay just where it is.

As much as it will seal Tasmania's maturation as an inclusive society, state marriage equality will break the seal on the national debate.

Rodney Croome has been at the forefront of the struggle for gay equality in Tasmania and is campaign director of Australian Marriage Equality. In 2003 he was a Member of the Order of Australia for his gay right advocacy.

（Getty Images）

“Are these songs about my relationship with a man? I say yeah.”

British-based, Lebanese-born pop singer Mika has confirmed he’s gay in an interview with Instinct magazine.

Ending years of speculation, he had already said he was bisexual in a 2009 interview, but now seems happy to ‘set the record straight’ – so to speak – describing himself as gay in the latest interview.

Instinct reveals a few quotes from their interview with the 28-year-old Grace Kelly singer for an upcoming issue. “If you ask me am I gay, I say yeah. Are these songs about my relationship with a man? I say yeah. And it’s only through my music that I’ve found the strength to come to terms with my sexuality beyond the context of just my lyrics. This is my real life.”

There was much about Mika’s debut album Lifr in Cartoon Motion which had prompted assumptions that the artist had a certain gay sensibility. The track Billy Brown told the story of a married man who embarked on an affair with another man. He sang:

Oh, Billy Brown had lived an ordinary life
Two kids, a dog and the precautionary wife
While it was all going accordingly to plan
Then Billy Brown fell in love with another man

And right from the early days of his career, Mika’s been aware of his a large gay fanbase. “I think I’ve been supported by the gay community hugely, if not pioneered by them,” he said in 2007. “I was pushed by the gay press in the UK before anyone else was pushing me… and I’m very proud of [that].”

Mika’s third studio album The Origin of Love is out next month.

Mother pleads for “gay panic” repeal

Queensland mother Joyce Kujala has called on Premier Campbell Newman to immediately end the notorious “gay panic” defence, which was used by the two men who beat her son to death in 2008.

Her plea was prompted by the early release of one of her son’s killers after just four years of a nine-year sentence.
Jason Andrew Pearce and Richard John Meerdink were jailed for the manslaughter of Wayne Ruks in a Maryborough churchyard .
The men attempted to use the state’s controversial provocation defence during their trial by saying that Ruks had tried to grab Pearce’s crotch before the attack. The court rejected the defence.

Pearce was granted parole and released early from jail on July 9.

The killing outside his church prompted Father Paul Kelly to launch his Change.org campaign to end the legal loophole, which has attracted more than 180,000 signatures and global support.

Kujala said last week that she hoped the Criminal Code would be changed to prevent the defence being used.

“This is a terrible loophole in the law that anyone can use to literally get away with murder,” she said.

“There is no condoning an attack on anyone, regardless of their race or religion or the way they live. This law is a loophole that simply encourages more crime.

“It’s time for Campbell Newman to close it.”

Father Paul Kelly said that the premier needed to realise the issue was not going to go away and that it was time for him to declare his stance on the defence.

“Campbell Newman says he is tough on crime. Now I’d like to see him show that he is by finally removing the gay panic defence,” he said.
Campbell Newman

“This is not just a gay rights issue, it is a criminal justice and human rights issue.

“There is overwhelming support for the removal of the gay panic defence and it is time Campbell Newman listened to what the community was saying.”

Earlier this month, Queensland Attorney-General Jarrod Bleijie revealed that he was unlikely to implement changes to the defence.

（文/搜狐IT）

Gay Marriage has $259M impact in NYC
by noreply@blogger.com (Bruce Yelk)

Gay marriage in New York City is proving to be an economic boon - having an economic impact of $259 million on the city.

Mayor Michael Bloomberg released that figure yesterday. The figure comes from a survey of approximately 1,700 gay and straight couples which were selected to complete online surveys about their wedding expenditures.

The surveys were conducted by a research firm hired by New York City and Company, the city's official tourism and marketing arm. Each couple answered questions such as how much they spent, the number of wedding guests they invited and from where those guests hailed.

Their answers were compiled and averaged out to create the following estimates:

— Each couple spent, on average, $9,000 on a wedding.

— Each wedding brought in about $12,000 spent by all wedding guests combined. That amount could include transportation or a hotel stay.

— Each wedding has a multiplier effect of about $10,500 on the city's economy. That includes any trickle-down effect such as the financial boon to restaurateurs who get hired for a wedding, who are then able to pay their rent or employees' wages.

— More than 200,000 guests traveled from outside the city to weddings. More than 235,000 hotel rooms were booked at an average daily rate of $275.

An analysis by the New York state Senate's independent Democratic conference had predicted there would be up to 66,500 same-sex weddings in the first three years and they would generate $311 million in revenue and economic activity.
