标题: 136签证被拒,还有什么补救办法.
我的情况说一下:
我共参加两次IELTS考试,头一次没达到每门5分,第二次没达到每门6分.
第二次考试成绩一出来,我就马上申请了成绩复议,但到今天为止,还没有复议结果出来.
发信给移民局咨询,也没任何反映,所以就又报名参加下个月的第三次偶的IELTS考试.已经交费了.

昨晚收到移民官的来信,讲我的136被拒绝,而且在信中,移民官讲,他没收到我的第二次IELTS成绩,所以,拒签证的理由是: 申请人的英语没达到Vocational English ability的要求.

我现在应该怎么办?

急,请各位大侠出手相救啊.
办法如下:
一、我应该如何抗议！
否则，我的IELTS成绩复议，如果能达到每门六分，我岂不是太亏了。
我如何要求移民官等1-2周左右，肯定复议结果就出来了。

二、没收到我的第二次考IELTS的成绩，要不要重新邮寄，有没这个必要？

三、6月份的IELTS还要不要再考？如果不考，名额可否转让给别人，退钱只能拿到1/3，实在是亏。

四、被拒绝后，再考出来的IELTS成绩有没用处？

晕啊。。。。。。

136比较惨，一旦决定翻案难。
再考一次，让你老婆加5分，赶紧再次提交申请看看？
回头要7分不就更没戏了。

基本没戏，看你怎么想了，铁心移民就再考一次，考到6的话，马上重新递交申请，赶在9.1之前。但是这么折腾一下，你可能在第二次申请过程中放弃哦，人是这样的人。

另外亚斯本来就是个硬性条件，不够分就over,没什么好埋怨的，而且楼主链120分都没够，

你不该这么做，成绩不合格绝对不要给他们。
考试方把成绩单给你寄过去了，移民局根据那个不合格的成绩单作的决定。
跟你差不多，我当初VO问我要我才去考试，也怕不到4个6，回头不好要求延期，所以没敢填让寄往移民局。
你太大意了。已经有这样被拒的了。
没有成绩好说一点，他们一般也不敢因为没按时补齐材料据你，因为要一两次延期也有的。一般看你有考试预约单也就给你延期了。
你一旦提供了不合格成绩单，他们就由足够理由拒你。
你再写信或电话解释解释吧。不过我觉得你犯错在先，希望能有机会吧。
实在不行，赶紧让老婆加5分，再次提交申请看。祝你好运。

我上这么久网,一直没听谁讲过,考试不通过,就不邮寄成绩单,怎么这一大细节给遗漏了.
我每次报名,都有一个习性,就是填写AU移民局的邮寄地址....

我不可能再提交交申请的.
因我在去年已经满35岁了,这也是我为什么先提交申请,后考试IELTS的原因.
谁都不想白扔钱.
,所以,我不可能再从头来过.即使考IELTS过了,也没戏.

所以,翻案是我唯一的出路.
走495签证,对我来讲,也不现实,因看了资料,495签证必须全家一起居留.
我原计划是136到手,配偶一人去的.
因我现在工作很不错.
主要是配偶想去.

翻案？机会微乎其微，找找澳洲移民律师咨询一下就知道了，别人没法帮你，相当于和移民局打官司，我的理解

我简单查了一下,哪个州的495签证里面,给2231-11计算机系统管理员,有职业列表,好像都没找到.
这就意思说,我这个ASCO还走不了495签证的啊.

被拒了就说明你的case结束了。你只能重新申请了！！！
这个群里第一次被拒再次申请成功的case不少，楼主努力吧！！！！！！！！！

被拒以后一个Case就算结案了。再考出雅思也没有用了。
你的雅思没有达到要求，VO拒你是很正常的。
但是有一点，如果你的雅思没有达到4个6分，而每门都超过了5分的话，VO不会拒而是放到Pool里面。

楼主，请你赶紧将你的第二次的IELTS的成绩单上的号码发给VO，告诉他你的IELTS成绩已经过了Vocation级别，这样他就无法判决你拒签。因为你只是分数暂时到不了120分而已（你IELTS暂时达不到6分），应该是可以放到POOL中去的，而不是拒签。也就是当你的到了120分（你考到了6分），你的申请会重新激活的。

我的雅思没有达到4个6分，而每门都已经超过了5分的话，如果按您所讲,VO不会拒而是放到Pool里面。

L5.5 R8 W5 S6,未达到每门6分.
申请137未成功,职业ASCO是2231-11,不在州提名范围内.

DECISION RECORD ON AN APPLICATION FOR MIGRATION TO AUSTRALIA

Requirements not met: Vocational English
I am delegated under Section 65 of the Migration Act 1958 to decide this application for migration.
A Skilled - Independent (Migrant) Class BN visa was applied for on 12th January 2006. As the
application was lodged after 1 September 1994, the Migration Regulations 1994 apply.
In considering the application, I have taken account of the Migration Regulations 1994 as they
apply to consideration of migration applications, including Schedule 1, Schedule 2 and
Schedule 6A; the Procedures Advice Manual (PAM3) which provides guidelines to officers
administering migration legislation; the Australian Standard Classification of Occupations (ASCO)
as it applies to occupation definitions and skill requirements in Australia; the relevant Country
Education Profiles (CEP), and the information contained in, and the documentation supplied with,
the application for migration to Australia.
Part 136 of Schedule 2 to the Migration Regulations sets out criteria to be met for the grant of a
subclass 136 visa. Amongst the requirements for the grant of this visa is the requirement which
states as follows –
136.224 The applicant has vocational English.
The regulatory requirement to demonstrate English language ability for this visa class generally
relies on an applicant’s International English Language Testing system (IELTS) test results.
Migration Regulation 1.15B prescribes the criteria for determining whether an applicant has
vocational English and subregulation 1.15(b)(3) provides that; for applications lodged after
1 July 1999;
A person to whom this subregulation applies has vocational English if:
(a) the person satisfies the Minister that the person has achieved an IELTS test
score of at least 5 for each of the 4 test components of speaking, reading,
writing and listening in a test conducted:
(i) not more than 12 months before the day on which the application was
lodged; or
(ii) during processing of the application; or
(b) the Minister:
(i) determines that it is not reasonably practicable, or not necessary, for
the person to be tested using the IELTS test; and
(ii) is satisfied that the person is proficient in English to a standard that is
not less than the standard required under paragraph (a).

This application is not one to which the provisions of subregulation 1.15(B)(3)(b) are applicable
and you were requested to provide the results of an IELTS test demonstrating that you have the
required level of English language ability.
On 8 September 2006 this office requested the applicant to provide the results of an IELTS test, as
evidence of having vocational English language ability, by 17 November 2006.
On 7 November 2006 you were granted an extension to submit documents by 15 December 2006.
On 21 November 2006 you were granted another extension until 10 April 2007.
At the time of making a decision regarding this application no IELTS test results have been
provided to the department in respect of the applicant.

As you have not demonstrated that you have Vocational English as specified in Migration
Regulation 1.15B and consequently do not satisfy the requirements of regulation 136.224 I have not
assessed the application further.

Further Consideration
I have also considered whether 配偶名 meets the primary criteria for the subclass 136 visa.
As this application was not accompanied by a skills assessment for her, I am not able to take into
account any claims that she might otherwise have had.
The remaining applicant is a child and has not been assessed against the primary criteria.
Assessment against Skilled-State/Territory-Nominated Independent (Subclass 137)

I have also assessed the application against the provisions of the Skilled-State/Territory-Nominated
Independent (Subclass 137). It is a regulatory criterion for this subclass that an applicant is
nominated by a State or Territory government agency.
137.224 (1) The applicant has been nominated by a State or Territory government agency and
the nomination has been accepted by the Minister.
There is no evidence before me that you have been so nominated.
I am not satisfied that you have met this essential requirement for a subclass 137 visa, and have not
assessed the application further for this visa subclass.

As you do not meet the requirements of either of subclasses 136 or 137, I have decided to refuse to
grant you a Skilled - Independent (Migrant) visa.
As the secondary applicants do not meet the requirements of either of subclasses 136 or 137 and are

3月底我做了IELTS的成绩复议,但目前为止,复议的结果没出来.

是啊,我也知道,所以觉得,很多地方矛盾的,移民官按信上所言,可能是没收到我的第二次IELTS,否则怎么会拒绝的理由是没达到Vocational E nglish....
但我的填写IELTS报名表时,已经填写过移民局的地址了.
我从来没管收到没有.因为两次考试分数线没达到.
所以,我生怕移民官来催促我.

三思，随好要去也一起去，免得后患

建议咨询一下专业的移民律师，争取向区的manager写信，反应一下情况。否则一旦136被拒了。很难有翻案的机会了。。

第二次亚斯扫描件发到region5去，据说region5这个信箱就是5区manager看的。。然后正文就争取多解释一下，还是建议找找专业移民律师，论坛有清风啊，寒萧啊。都不错。多想想办法。

刚才仔细看一考试中心的网站的说明，看来我的报名的时候，填写的地址，是没用的啦！因为二次的成绩都没达到每门6分，所以，我确实从来没问询过考试中心，到底有没寄出成绩单？按这种说明，移民官应该是从来没收到我的IELTS成绩的

但这位Anna移民官也真的是很粗鲁，在我对拒签提出质疑的时候，她马上又发出第二个信，confirm refusalletter，变态的苏联人。
她压根从来没问过我，没接到我的IELTS成绩，因我参加的两次IELTS考试，都没达到每门6分，所以每次考试结束都是口头上通知移民官的。而且，确实我也没关心，,她是否收到过我的IELTS成绩单。
但她突然一下就冒出：“拒签的信来，也实在太让我难接受。

如果她前面有问过我，没收到成绩单，也死而无遗憾啊。否则，她需要提供IELTS的成绩，我肯定能寄给她的啊.

Region5这个信箱不存在：（
如何投诉这个变态佬。。
太过份了，从来没说她没收到成绩单，我一直以为她收到了。
从去年底2006年12月份之后，我发的所有信，她都没回复过一次。
今年3月考试成绩出了，我也发了无数信，想再参加第三次考试，她也没任何回复。
所以，我无可奈何一直等待着。。。。

建议lz找澳洲的移民律师为你打官司翻案，可能要多花一点钱，总比现在郁闷着不知怎么办好。

不忙，先跟你再确认一下：填报名表在比较靠前的页面（忘了具体哪页，但是应该是和联系方式什么的在一个页面）确实要填成绩单寄送地址，这里的地址是指考试中心把ielts成绩怎么寄给你自己的方式；另外在差不多最后一页我记得会有5个大框框填地址的那页会说可以免费寄，问要不要寄。你一直说你填了移民局地址，你到底在哪张页面填的？正确的做法是靠前的那张页面填自己家/公司地址，靠后面那张页面一个地址都不要填。如果你在后面那张页面填了移民局，那考试中心是会帮你寄的。

关注。。。LZ最好把细节弄清楚，到底当时给雅思中心填的什么地址，当时有FN没有，有没有写上去。雅思中心到底帮你寄了没有，寄到哪里去了，有没有当时邮寄的具体细节，如快递单号，签收日期，签收人等，这些应该有记录的吧，这样你才好查到底是否已经寄了成绩。如果寄出了他们收不到，这些细节是重要证据，而且也可以帮助他们找回你的成绩单吧。

这样被拒太可惜了，不要放弃哦，支持你

我是填写在第二页，就是那有五个框框的地址栏目，二次的报名都填写了。
同时，也给IELTS考试中心打了电话，他们查询是没寄出。只寄给我自己一份。
但事情同时也越来越不走运，因当前正在做2007年3月的成绩复议，考试中心不能提供原件的邮寄服务。
因我自己收到的唯一那份考试结果的原件，也已经同《复议成绩申请表》，早先一同寄往了广州British Council，现在怎么办？考试中心讲，按规定，复议期间不允许寄送额外成绩单。
要我等2周，才会出复议结果，然后，才会出具成绩单！

考试中心要求移民官直接给他们打电话或EMAIL，直接问询或查询我的成绩单，但他们不可能---主动发起向移民官打电话。

但移民官多一天都不等，今天下午又还发来confirm Refusal letter继续威胁我，任何的申诉没用的。也不会给IELTS考试中心打电话，两边都卡住了。
我会尽最大努力，非常感激FREEOZ的移友和版主们，给我的信心，给我的温暖！
不管移民能否成功，都是一次最好的人生磨砺！

第一次考试在11月底，成绩一出来我就主动汇报，然后争取到她同意我第二次IELTS考试，是今年年3月份，月底成绩一出，我也发了许多MAIL告诉她，没达到每门6分，想争取再考，但她没任何回复。
因为从去年底开始，全是邮箱自动回复的信。

一定要正式投诉，保存来往邮件。如果考试中心没有寄，请他们邮件回复，并将邮件转发移民官，这个也是证据，而且现在没有邮寄成绩单这一点很关键，是移民官拒绝你的理由。老是口头打电话没有用的，就算你以后要告考试中心和移民局，也要这些证据才行的。

多谢移友提醒，急啊，邮件也发了，但没回复，所以才打电话的。
我也没把握，好歹也十多年没摸过英文了，底子再好，也要时间，又天天上班+加班的。
我也想考过IELTS再投申请，无奈年纪正好将满35岁，肯定不愿意白丢钱钱给他们的。

楼主，我看来现在你要证明的就是你可以达到Vacational English，这样她就不能拒你了，但你的成绩单又不在，没有那个号码，是很难让她查到你的成绩的。
请联系IELTS的部门，看他们是否能查询到Test report form number给你。

号码都在，我已经全提供给她了，但她不愿意，她讲一发出拒签信，就没理由进行申诉的。
移民官拒绝联系EILTS考试中心。就是关键所以，我已经向她的上司申诉了。
明天等结果吧。

还是没想明白，既然填了代寄单，照理说两次成绩都会自动寄出的，怎么LZ给IELTS考试中心打电话时，他们查询是没寄出呢？那应该是他们的失职呀。
虽然代寄时有说明（澳大利亚和英国除外），那是指各国使领馆的签证处，ASPC是属于寄送范围的。

其实你现在寄送雅思成绩根本不用由雅思考试中心寄送，自己寄过去复印件或扫描件就能被接受。

估计是楼主第二次雅思成绩没有寄送成功，你自己也太粗心了，自己将扫描件寄到指定的信箱就可以了。

确实是因为VO没有收到你第二次(vocational english ability)雅思成绩，才作出这样的决定的。你现在只能说没有达到（competent english ability），最多因为差5分被POOL。

不知谁能提供经理信箱，写信给经理试试。

移民局的人有时候非常糊涂的，我当时的清华认证6月份就寄出了，可是到9月份，移民局居然来信问我真么还不寄清华论证，如果再没有收到就要cut我的case，我立即联系澳大利亚大使馆（当时清华认证是由清华大学寄到澳大利亚大使馆，由大使馆发往移民局的），确认我的清华认证已经从他们那里寄出，应该到达移民局了，最后是VO自己把信压在文件里面了，没看见，当时他知道是他的mistake，立即给我发了体检表。8过LZ的case是考试中心没有发信，应该不太一样，不过既然存在问题就应该争取一下。祝你成功！

楼主自己手上没有雅思成绩单原件吗？扫描一份给aspc就可以了啊。还有，我觉得很奇怪，你怎么可能口头跟你的移民官确认亚斯成绩的事情呢。根本不给让跟移民官直接电话啊。找出你们通讯的文字纪录然后走投诉路径看看是否可行吧。

写投诉信是没用的,我LG是因为背雕时把工作时间说错了被拒的,我们就给他的经理发信投诉.第一封回信说已经了解情况认为他们的工作没有问题.第二封信我们又加了证明,回信说已经决定不能更改了,如果符合条件可以马上再递申请.而且我听说过想你这样的雅思被拒就算复议了也没用的.

我的第一次考试成绩没寄出,不知道什么原因.
第二次考试成绩肯定已经寄出,考试中心提供了寄出时间是3月28日.
我已经加在投诉信中了.
因第二次的成绩做复议,所以没办法像楼上的朋友讲的,做扫描或复印.
如果被拒绝,我觉得是命运的安排,就安心留下,不想再申请了.
留下搞好祖国建设吧.

你应该先联系雅思考试中心阿，英国领事馆教育文化代表处雅思中心，立刻打电话给工作人员，说明情况请他们把雅思成绩单给你。

你第二次雅思如果每门都达到了技术移民基本要求的5分，是不可以拒签，而应该pool的，因此赶紧像移民局提供每门都达到5分的雅思成绩单来确保移民申请被pool是当务之急。被pool了，雅思可以考了再考，原移民申请还是有效的，可以重启。如果这次再提供不出雅思成绩单，还是维持拒签，将无法翻案。

总算有希望了，下周估计成绩也该出来了。在25号前给他们扫描完发过去就好了。

应该是的，你可以自己在网上查一下入池和出池的条件。

另外，给你写信的澳洲移民高手不是“他”，而是“她”。她本身就是一个不错的移民中介，挺讲信用的。
