A LEARNER driver who admitted a string of charges over a fatal head-on crash near Perth Airport has been sent to a higher court where he faces tougher penalties.

Guelor Lutumba, 29, pleaded guilty to eight charges in the Perth Magistrates Court in February, including dangerous driving causing death, two counts of dangerous driving causing grievous bodily harm, and three counts of dangerous driving causing bodily harm.

Today, Chief Magistrate Steven Heath ruled the Thornlie man should be sentenced in the District Court for the more serious charges of dangerous driving causing death and grievous bodily harm.

In the Magistrates Court the maximum penalty for dangerous driving causing death is three years jail.

In the District Court, the maximum penalty for the same charge is 10 years jail.

The two-car collision happened on Dunreath Drive, Redcliffe, about 8.45pm on New Year's Day this year.

Lutumba was driving his Holden Commodore north-west along the road when he attempted to overtake a truck and collided head-on with another vehicle.

The crash claimed the life of a 40-year-old Queenlsand woman who was a passenger in Lutumba's car.

Four other people in the car, including Lutumba and a six-year-old boy, were taken to hospital with serious injuries.

During proceedings today, a police prosecutor told the court the visibility was good and street lights were working at the time of the crash.

She said Lutumba was seen driving dangerously close behind a truck, before crossing the double white lines to overtake the truck at a curve in the road.

The prosecutor said Lutumba was a learner driver and had failed to display his L plates.

She said he was also driving a car which was subject to a compliance notice.

Lutumba's lawyer, Marc Saupin, said the charges should stay in the Magistrates Court because there were no circumstances of aggravation.

He said though Lutumba was a learner driver, he had about three or four years' experience driving in the African country of Cameroon.

Magistrate Heath said it was appropriate to commit the three more serious charges to the District Court and released Lutumba on bail until his next appearance in June.

我常大力劝说，新移民拿 L 牌或国际驾照期间，是事故的高发期。

能够保障安全的，一是教练，二是全险。

我注意到一件很独特的状态，技术移民的大多都会注意安全，事故较少较小。

而留学生就不一样了，买了台2-3千刀的烂车，马路横冲直撞，什么保险都没有，说起话来还一副很牛X 的样子。

只能摇头叹息，无言以对。

年纪不同，生活经验不多，对生命和风险的意识也不同。

记得听谁说过在kiwi国L牌没教练独自开车出事的话罪名是三级谋杀...
