Case Law
Legal principles enunciated and embodied in judicial decisions that are derived from the application of particular areas of law to the facts of individual cases.

Since the U.S. legal system has a common-law system, higher court decisions are binding on lower courts in cases with similar facts that raise similar issues. It means that appellate case law should be considered as binding upon lower courts.

Reasonable doubt is a standard of proof used in criminal trials. When a criminal defendant is prosecuted, the prosecutor must prove the defendant's guilt Beyond a Reasonable Doubt. If the jury—or the judge in a bench trial—has a reasonable doubt as to the defendant's guilt, the jury or judge should pronounce the defendant not guilty. Conversely, if the jurors or judge have no doubt as to the defendant's guilt, or if their only doubts are unreasonable doubts, then the prosecutor has proven the defendant's guilt beyond a reasonable doubt and the defendant should be pronounced guilty.

Reasonable doubt is the highest standard of proof used in court. In civil litigation the standard of proof is either proof by a preponderance of the evidence or proof by clear and convincing evidence. These are lower burdens of proof. A preponderance of the evidence simply means that one side has more evidence in its favor than the other, even by the smallest degree. Clear and convincing evidence is evidence that establishes a high probability that the fact sought to be proved is true. The main reason that the high proof standard of reasonable doubt is used in criminal trials is that criminal trials can result in the deprivation of a defendant's liberty or in the defendant's death, outcomes far more severe than occur in civil trials where money damages are the common remedy.

Notes:

Jury system--Used in criminal law, in which jury is comprised of 12 members. To convict an accused,at least 10 out of 12 members have to be convinced of the accused's guilt based on all the evidences admitted into that case.However, if it is 一级谋杀刑事案件,只要其中任何一个人有不同意见,法庭都不能宣判。(Please refer to @江南柴进 's post: http://freeoz.org/ibbs/forum.php?mod=viewthread&tid=986535 )

Jury selection rule--Any citizens can be chosen to be a member of a jury panel, and all citizens have the legal responsibility to serve the jury's duty whenever called upon.

However, the candidate has to have no knowledge about what is going on with the particular case he/she serves, just in case, his/her preemptive perception could possibly impair the accused's fair trial. He/she has to be an impartial person when it comes to a particular culture, religion and population. For instance, if a potential jury member is found to have a bias on muslin, he/she won't be able to be selected to a jury panel who are about to hear the case that involves any muslin people.Just in case, that bias will play a negative role in muslin suspect's fair trial.

That's why as long as a murder case becomes a high profile one, it will get extremely hard to select the jury panel. Then, the trial will be unbearably postponed and unfavorably affect the victims.

Also, as long as the jury panel is established, all members will be isolated from the public contact. They are not allowed to read newspapers, watch any TV programs relevant to the case in trial, to discuss with any outsiders about the case. Their only source of information about the case is from the court room.

So, in the process of the trial, if any jury member broke the rules, the whole trial would be coming to an abrupt end, the jury panel would be dismissed and re-selected!

I guess that's one of the reasons when the judge pronounces an accused's guilt, he always can make such a statement confidently: Your guilt of murdering the deceased is beyond reasonable doubt!

补充一点,预审是英美法系优势的一大体现,通过预审很多案件可以免于起诉,大大节省了纳税人的钱。
