The Australian Citizenship Act 2007 is the legal basis for all citizenship provisions. It commenced on 1 July 2007.

What are the new residence requirements for Australian citizenship?
The new residence requirements for Australian citizenship in the Australian Citizenship Act 2007 mean that applicants will need:

four (4) years lawful residence in Australia immediately prior to making an application for Australian citizenship with at least 12 months as a permanent resident, and
absences from Australia of no more than 12 months in total in the four (4) years prior to application, and no more than three (3) months in the 12 month permanent residency period prior to application.

对于7月1日前已经登陆的移友，Will they affect current permanent residents?
The new residence requirements will only apply to people who become permanent residents on or after 1 July 2007.

People who became permanent residents before 1 July 2007 need only meet the old residence requirements (presence in Australia as a permanent resident for periods amounting to two (2) years in the last five (5) years including one (1) year in the last two (2) immediately prior to making the application) provided they applied within three (3) years from the day the legislation commences.就是说如果在2010年7月1日前满足居住条件，就可以按照旧的入籍法提出入籍申请。

呵呵，也就是最在2008年7.1号以后一直住在OZ就行了，换句话说你现在去还是两年的移民监

同意！对于已经是pr的，理论上2008年7月1日前第一天登陆然后两年待在澳洲的不需要4年移民监。

我怎么还不太明白,我们现在都还没有拿到PR, 如果拿到了,去澳洲也要呆满3年才可以入籍吗

真想知道要呆几年?

看来是这样的，凡是07年7月1日前在澳大利亚登陆的PR，只需要两年时间就可以入籍了（适用老的入籍法律），之后的需要四年时间。对于在此之前拿到PR但没有登陆的人而言，可能需要四年了。

2年4年的就不要考虑那么多了，有这精力不如多想想以后的发展计划，如何学好英语，如何尽快找到工作，如何面对未来的生活。

严重支持楼上的说法，我觉得大家都把2年或者4年看得太重，难道真的有很多移友都是仅仅为了一个身份吗？那就太失去移民的意义了，再说我发现有很多TZ赶在前两天登陆了，可是如果你不在2010年7月1日之前申请入籍，那也是白搭啊，还是应该考虑考虑以后的打算才是上上策嘛！

这似乎可以理解为：成为永久居民前在澳洲连续住了3年以上的人在拿到永久居民后马上在澳洲住上一年就可以申请公民了。因为Lawful residence 并不是permanent residence。个人拙见而已，见笑了

等待期是4年，但在这4年的等待期里面，你要在OZ呆至少3年。因为你可以在这4年里离开OZ不多于12个月。而且在最后一年里，最多离开OZ不超过3个月。

我也是这样认为的。

只是我对Lawful residence有疑问——怎样的Residence才算Lawful呢？学生签证、495、496这些肯定算，旅游签证、探亲签证算吗？

Lawful 应就是合法的、没有任何触犯法律行为的。在Policy check方面没有污点的人就算是lawful了。
